Biography


Jim Weiss is a dedicated and tireless advocate for his clients.  A third generation Texas lawyer, Jim is known for his ability to understand complicated issues and translate them into a compelling, powerful story for judges and juries.  Jim represents individual and corporate clients at the trial and appellate levels in disputes across various subject matter, including oil and gas, partnership, real estate, and intellectual property.  Jim has experience with all aspects of litigation including pre-suit investigation, discovery, depositions, briefing and arguing critical motions, and mediation.  Jim has also successfully represented clients in injunction proceedings, final arbitration hearings, and jury trials.

Jim approaches his law practice with the intensity, intellectual rigor, and discipline of a scholar athlete. He played varsity lacrosse at Princeton University before graduating from The University of Texas School of Law with Honors. After law school, Jim clerked two years for Judge Sam Sparks on the U.S. District Court for the Western District of Texas, Austin Division, on one of the busiest civil dockets in the country. While clerking for Judge Sparks, Jim learned the ins and outs of federal motion practice and procedure while observing firsthand what influences and persuades both judges and juries.

Representative Matters


Phoenix Services

Won a jury verdict in Oklahoma state court for Phoenix Services, an oilfield services company, in a lawsuit against NextSource Water Solutions over the cost to construct a $10 million frac waste water gathering system in Arnett, Oklahoma.  Phoenix hired NextSource to design and manage construction of the pipeline system.  After the project was substantially completed, NextSource issued additional invalid invoices.  Phoenix disputed the invoices, and NextSource filed property liens and a lawsuit in Denver, Colorado.  On our motion, the state court in Denver dismissed NextSource’s suit for lack of jurisdiction.  We filed a follow-on lawsuit in Oklahoma and ultimately tried the case to a jury.  The jury returned a verdict in Phoenix’s favor on all counts.  Following the judgment, the parties entered into a settlement agreement whereby NextSource agreed to pay Phoenix’s attorneys’ fees, costs, and expenses.

Confidential Arbitration

Represented oil and gas midstream company in a dispute with a producer, relating to producer’s failure to sell gas and natural gas liquids (NGLs) produced in Southeast New Mexico committed to the midstream company.  Brought claims under a gas purchase contract and an NGL purchase agreement, seeking declaratory relief regarding the midstream company’s rights under the contracts and specific performance of the producer’s obligations.  After a seven-day arbitration hearing, the arbitration panel issued an award to our client under both contracts, which included declaratory relief, specific performance, damages, and attorneys’ fees.

Colgate Energy

Hired by oil and gas E&P company after a major midstream company sued and obtained a temporary restraining order the same day of filing suit that would effectively force Colgate to shut in its wells. Less than two days later, filed an emergency motion to dissolve the TRO, which the court granted the same day thereby allowing Colgate to continue well operations.  After two weeks of intensive discovery and a full-day evidentiary hearing, defeated the midstream company’s request for a temporary injunction.  Shortly thereafter, filed a motion for summary judgment, which the court granted as to critical claims asserted by the midstream company.  Following this ruling, the case settled on favorable terms.

Confidential Arbitration

Represented a major oil and gas producer in a confidential arbitration against an oilfield services company. Prosecuted multi-million dollar claim for breach of contract and defended against eight-figure counterclaim. Served as second chair in a five-day arbitration hearing and following a decision from the arbitration panel in our client’s favor, the case settled favorably for a confidential amount.

Pantheon Resources

Key member of litigation team that achieved a complete victory for Pantheon Resources, an oil and gas E&P company, against a former consultant seeking to impose an overriding royalty interest on leases in Tyler and Polk Counties. Secured summary judgment, a dismissal of each of the former consultants’ claims with prejudice, and a declaration from the Court that the former consultant was not entitled to any royalty interests or payments from our client.

Phoenix Services

Represented oilfield services company in lawsuit against co-founder who was dismissed for cause but still owned large ownership interest.  Defendant challenged venue and asserted many counterclaims under employment agreement and LLC operating agreement.  After discovery and shortly before summary judgment hearing, case settled favorably and defendant relinquished his ownership interest.
