We represented Balli Steel plc (“Balli”) in two related cases involving the defense of claims and the prosecution of counterclaims and claims against Mid-Vol Coal Sales, Inc. Concept Coal and ArcelorMittal, with respect to a long-term contract for the purchase of metallurgical coal. Balli sought to recover damages of more than $30 million based on the seller’s failure to deliver coal in accordance with the contract. Ultimately, the case settled in July 2016, shortly before the trial was scheduled to begin.
