Mustang retained the Firm to defend an arbitration filed by Coffeyville arising from a catastrophic explosion and fire at the Coffeyville Refinery in Coffeyville, Kansas, which resulted in a fire that caused substantial property damage and significant business interruption. Coffeyville claimed that the blowout was caused by a negligent design by Mustang and that Mustang should be held liable for all losses incurred by Coffeyville. Coffeyville originally filed its arbitration demand in December 2013, but the arbitration panel granted our Motion to Dismiss because Coffeyville failed to comply with Texas law requiring that any arbitration demand against a licensed engineer include a certificate of merit, sworn to by a qualified expert. On October 22, 2014, Coffeyville re-filed the arbitration along with a certificate of merit. After discovery, the case settled in early 2016 on confidential terms.
